Terms & Conditions

1. Acceptance of terms

By accessing or using the Site, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Site.

2. Accounts and sign-in

The member area uses passwordless “magic link” sign-in: you enter your email address and we email you a one-time link to log in. You are responsible for keeping access to your email account secure and for all activity under your account. You must provide a valid email address and may not impersonate others.

3. Acceptable use

You agree not to misuse the Site, including by attempting to access areas or data you are not authorized to access, disrupting the Service, scraping or harvesting data, or using automated means to submit forms or create accounts.

4. Purchases and payments

Where paid products, courses, or memberships are offered, payments are processed by our third-party payment provider (Stripe). We do not store your full card details. Prices, access terms, and any refund terms are those stated at the point of purchase.

5. Intellectual property

All content on the Site is owned by us or our licensors and is protected by intellectual-property laws. This includes text, videos, course materials, graphics, and the Authentic Essentialism framework. You may not reproduce, redistribute, or create derivative works from it without our written permission, except as expressly permitted for your own personal, non-commercial use of purchased materials.

The Site may link to third-party websites or products. We are not responsible for the content, policies, or practices of those third parties.

7. Limitation of liability

To the fullest extent permitted by law, the Site and its content are provided “as is” without warranties of any kind, and we are not liable for any indirect, incidental, or consequential damages arising from your use of the Site or reliance on its content. See also the Disclaimer below.

8. Changes to these terms

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms. The “Last updated” date above reflects the most recent revision.

9. Governing law

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Utah.

We respect your privacy and are committed to protecting your personal data. This section explains what we collect, how we use it, who we share it with, and your rights.

The DownshiftFocus Chrome extension has its own policy: DownshiftFocus privacy policy.

1. Information we collect

  • Email address: when you subscribe to our newsletter, request a free guide or lead magnet, or join a waitlist (such as the 6 Hour Creator waitlist).
  • Account and profile information: such as a user handle or display name you choose.
  • Purchase information: if you buy a product, our payment provider processes your payment details. We receive confirmation and limited transaction data, not your full card number.
  • Usage and device data: such as pages visited, referring links, browser type, and approximate location, collected through analytics cookies (see “Cookies” below).

2. How we collect it

We collect information directly from you when you submit a form or create an account, and automatically through cookies and similar technologies when you browse the Site.

3. How we use your information

  • To provide the Services, including member sign-in and access to courses and tools.
  • To send you the emails you signed up for (newsletters, guides, waitlist and product updates).
  • To send transactional and account emails, such as sign-in links.
  • To operate, maintain, secure, and improve the Site, including understanding how it is used.
  • To process purchases and provide support.

We rely on your consent (for marketing email and non-essential cookies) and our legitimate interests / performance of a contract (to operate the Site and provide Services) as the legal bases for processing, where applicable.

4. Service providers we share data with

We do not sell your personal data. We share it only with service providers who process it on our behalf to run the Site:

  • Convex: application backend, database, and hosting (stores your account and subscriber records).
  • Resend: delivery of transactional and sign-in emails.
  • Kit (formerly ConvertKit): email marketing. When you subscribe, we may sync your email address and a tag to Kit so we can send the relevant emails and sequences.
  • Google Analytics: website analytics (see “Cookies” below).
  • Stripe: payment processing, where you make a purchase.
  • Bunny (bunny.net): content delivery for media such as images and video.

Each provider processes your data under its own privacy terms and only as needed to provide its service to us.

5. Cookies and similar technologies

We use:

  • Essential cookies: required for sign-in sessions and core functionality. These cannot be turned off without breaking the Site.
  • Analytics cookies (Google Analytics): help us understand how visitors use the Site (pages viewed, traffic sources, general location and device information). Google Analytics may set cookies and collect a truncated/pseudonymized identifier and IP-derived location. You can opt out using the Google Analytics Opt-out Browser Add-on, and you can control cookies through your browser settings.

Where required by law, we will request your consent before setting non-essential (analytics) cookies.

6. Email marketing and opting out

Every marketing email includes an unsubscribe link. You can opt out of marketing emails at any time; we will still send essential account and transactional emails (such as sign-in links) while you have an account.

7. Data retention

We keep your personal data for as long as your account or subscription is active, or as needed to provide the Services and meet legal obligations. You can ask us to delete your data (see “Your rights”).

8. Your rights

Depending on where you live (for example, under the EU/UK GDPR or the CCPA), you may have the right to access, correct, delete, or port your personal data, to object to or restrict certain processing, and to withdraw consent. To exercise these rights, contact us via our contact page. We will respond within the timeframe required by applicable law.

9. International transfers

We and our service providers may process your data in countries other than your own, including the United States. Where required, we rely on appropriate safeguards for such transfers.

10. Children

The Site is not directed to children under 16, and we do not knowingly collect personal data from them. If you believe a child has provided us data, please contact us and we will delete it.

11. Contact

For any privacy request or question, contact us via our contact page.
